Kerry Reilly Photography Terms & Conditions
Note – For the purpose of this document Kerry Reilly Photography shall be referred to as KRP. The visitor to the studio shall be referred to as the Client.
APPLICABLE LAW
The laws of England and Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.
In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.
BOOKING & PAYMENT
By booking with KRP you enter into a contract and have therefore agreed to abide by the terms and conditions.A non-refundable booking fee of £50 will be taken to secure your session date. For newborn sessions only: Due to the uncertain prediction of an exact arrival day of your baby, certain flexibility for booking the newborn session will apply. An initial date within the first 10 days of your due date is to be pencilled, however, this is subject to change depending on the exact date of birth.
Once agreed upon a final session date, you may reschedule your session up to 7 days prior to your shoot if required. After this a £40.00 rebooking fee will be charged. Booking fees are non-refundable but transferable for up to two months of the original session date (should you wish to change the date). Each session date can be transferred only once.
The £50 booking fee will go towards paying off your chosen Portrait Package. Payment for the full package can be split in to separate instalments. Full payment must be made on the date of your final session. The same reschedule terms as stated above apply to each session within the package.
ORDERS
All orders for additional packages, frames or canvases must be paid for at the time of ordering unless a payment plan has been discussed.
If a Payment plan has been arranged a non-refundable initial payment of £100 will be taken at the time of ordering and remainder will be paid off as arranged. If the client fails to pay on time for the remainder of any additional orders, KRP reserves the right to withhold the products until full payment has been made. If the client falls behind on payments for more than two months KRP retains the right to discard the order completely. Any payments made up until this date are non refundable. The sale will be considered closed and KRP retains the right to take the matter to the Small Claims Court to retrieve the remainder of the payment.
All orders will be completed and available for the Client to collect within 8 weeks of the viewing date, for any orders that are completed before this date the Client will be notified.
All images produced by KRP are done on a fully calibrated monitor, and all prints will be a true reflection of the editing carried out by KRP. KRP will not be held responsible for variances in images caused by clients viewing images on non calibrated screens or monitors. To ensure images are seen as intended it is advised that client views them at KRP studio. When high resolution images are purchased it is not the responsibility of KRP for any discolouration or cropping when products are ordered elsewhere.
By placing an order with KRP you are committing to buy the ordered products.
FULFILLMENT OF OBLIGATIONS
KRP shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.
The Client understands and accepts that the photographic coverage will be as KRP’s professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.
In the unlikely event of total photographic failure or cancellation of the contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.
If the Client fails to carry out required preparations prior to a session, KRP will not be held responsible for any resulting reductions in quality or quantity of images supplied.
SICKNESS
We understand that children can be unpredictable and fall ill at any time. In the event of sickness prior to the session, the Client agrees to make every possible effort to inform KRP no later than 24 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum 2 month period. KRP reserves the right to re-schedule outside of this time limit due to any existing commitments. If the Client fails to reschedule within the 2 month time period, KRP has the right to cancel the booking with all payments made non-refundable. In the event of the child falling ill during the session, KRP reserves the right to postpone the photo shoot and re-schedule at the convenience of both parties.
As with the client, if the designated photographer falls ill KRP retains the right to re-schedule session at the convenience of both parties.
RETURNS POLICY
Returns will not be considered for incorrectly ordered items or items ordered in error by the client. The client is shown the order form at viewing and will sign to say the order is correct.
The client will be shown items on collection, this is their opportunity to check products ordered. Any damage that is made to them after they have been handed over is the responsibility of the client. If the client is not satisfied with the products this should be discussed before they leave the studio.
Faulty items, incorrectly supplied items and items of poor quality will be replaced at no extra charge to the Client.
No return, exchange or refund is available on any item once an order has been placed.
COPYRIGHT
It is understood that the copyright of all and any photographs belongs to KRP. No photographs may be copied or reproduced by any means, photographic or otherwise by any person or machine, other than by the photographer or her appointed agent, unless the high-resolution pictures are purchased by the Client. Releasing photographs online by the Client (i.e. Facebook, blog or any other online channels) are prohibited unless the photographer’s company name, Facebook Page and/or Website is tagged or mentioned along with the image.
STORAGE
After 3 months from your session date KRP will no longer be responsible for storing your image files.
MODEL RELEASE
Unless stated on the booking form KRP has the right to use any image from our photo session for industry competitions and as required subsequent usage and for general promotional advertising for KRP. KRP is entitled to use all images produced for exhibitions, editorials, digital and print marketing, publications, educational DVDs and websites, and/or display purposes.
Unless stated on the booking form KRP has the right to use any image from our photo session for advertisement on social media.
MISC
Although KRP shall exercise all reasonable skill, care and diligence in the discharge of her duties, it is understood that, in the event of any unforeseen circumstances causing loss of photographic record, the photographer will only be responsible for the return of all the money paid to date, although every effort will be made to re-take the photographs.
CAMERA POLICY
Cameras, camera phones, camcorders or any other recording equipment is NOT permitted during any session, either in the studio or on location, without the express permission of KRP.
